Troubleshooter update 8/23/17

​LEGISLATION - In a bi-partisan effort, Pennsylvania congressional representatives recently introduced two pieces of legislation that, if passed, will greatly strengthen your claims and protect homeowners in Pennsylvania. 
 
The first bill (HR 1831) seeks to extend the time frame for the statute of repose from 12 to 15 years.  Under the new bill, if injury occurs between years 13 and 15, the timeframe would be extended to 17 years.  This bill essentially gives everyone (including specifically, subsequent purchasers) an additional 3 years from the current state of the law.
 
The second bill (HR 1833) requires homebuilders to notify homeowners of known defects within 30 days of the builder’s discovery of the defect.  The builder must describe the defect and explain how it became aware of the defect.  The bill is aimed at preventing builders from concealing known defects and intends to better inform homebuyers of construction defects.

We encourage you to call your representatives and urge them to pass this legislation.  While this legislation, if passed, may not guarantee a legal victory, it will strengthen your claims and take some defenses away from the builders.

This is an excellent development and shows that the legislative trend is arcing towards protecting consumers and holding the builders responsible.

The type of material doesn't matter!

The Action News Troubleshooters have warned their viewers about the issue as it related to stucco houses, but now they have learned other homes are impacted including those built with vinyl, brick, cultured stone, and fiber cement siding.
